I think the Wizards will almost have to try to terminate his contract as well. If they opt not to, it lends a credible defense to Arenas. There are certainly mitigating factors (priors, felony vs misdemeanor) that elevate Gilbert's case, but the Wizards look dodgy if they go after the fat contract and ignore the lesser one.

I don't know if they would both be heard in the same arbitration case or separately.
