    It may come out that you are right, but I think it is premature to label this a racially motivated attack at this point.

    reasonable person is such a rabbit hole. The point of castle doctrine and stand your ground laws are to eliminate the quagmire created by that test. No reasonable cop enters a guys apartment and shoots him to death.

    She lacked the use of reason during multiple decisions that led to the murder.

    Would be irrelevant. He's a Texan with someone at his door at night. A gun in hand is a good idea. Might have saved his life here.

    If ya'll don't want her to walk, then you better start using the term "manslaughter" instead of "murder."

    Ya'll are misinterpreting the meaning of "intent" here -- she had to have intended to kill him when going to his apartment, not intended to kill him when she pulled the trigger.

    my understanding (I may be wrong) is that his door had a peephole and that he had looked through it to see a police officer in uniform at his door. That may have just been a speculative claim made by someone here or elsewhere, I don't remember where I saw that.

    I agree with you that a "gun in hand" in the middle of the night might be a "good idea," but in that case she's got a lot more forgiveness on her side if it turns out that's what happened

    On point 1, good point. On point 2, again not a lawyer, but I'd think that'd be necessary for premeditated murder, but not second degree murder.

    This. Clearly manslaughter. I think the issue is how easy cops get off on manslaughter, but I don’t see this being the case.

    a 98 year old woman . . . .would not get shot in that situation
    a 16 yr old white boy .. . .would not get shot in that situation
    a 36 yr old white man . . .would not get shot in that situation

    A distinction NO ONE WOULD ATTEMPT TO MAKE if their situations were reverse
    a Black man went to the wrong door and shot a white woman that opened it .. . . ..
    I SERIOUSLY doubt this type of splicing would happen
    it would simply be. . .. KILL HIM by lynch of by needle but his death would be a rallying cry

    While I understand your point and agree that him being black likely played a key role in the womens reacting, a 36 or 16-year white male could definitely appear dangerous depending on the situation and their appearance.

    To follow up on my own comments of murder and manslaughter, I found this random link. See the section on Imperfect Self Defense, where it says a charge may be reduced to manslaughter if the homicide was in self-defense but the underlying fear was unreasonable. That sounds apropos here. Still, I'd like to see them pursue murder with a manslaughter charge as the lesser included offense to give the jury the option of either one.

    She shot a dude last year after she was too pathetic to secure her taser. He might have been white in cargo shorts. She clearly isn't afraid to send rounds anytime she feels like it. Twice in four years is a strong indicator.

    Hope the family sues the crap out of DPD for even giving her a gun again.

    ...what kind of odds would anybody give me that this officer gave this poor soul verbal commands that he failed to follow, prompting her to respond with deadly force...?

    ...that's a story that the department could come up with inside of 72 hours easy...

    Some of you might remember this incident in 1992. Shoot first, ask later. Fear with gun is deadly. All these incidents are tragic. I get the want for punishment and justice, but there is a much larger cultural issue here.
