Not in a place where they cannot respond, and where protocol indicates that they sit stone faced while a bunch of congress members stand up and clap and cheer or heckle in their general direction. Obama's statement was "ok" at that time because it was part of his state of the union address-- he wanted rules enacted this year to soften the feared effects of that ruling. The slightly antagonistic tone of the statement wasn't necessary. The boisterousness from Congress certainly wasn't necessary. The "not true" from Alito was not a big deal. The comments from Roberts here aren't a big deal either. There's no reason he should remain silent on how he feels on the subject if he is going to be publicly answering questions about any other topic. I don't think this is all that big of a controversy, though. Roberts didn't seem like he was making any kind of inflammatory or partisan statement. He was just commenting that he didn't think criticizing the Supreme Court and having a large part of Congress cheering it on in that setting was appropriate. I tend to agree, but again this is just a molehill. It's an interesting topic of discussion, not any kind of judicial versus executive sparring match.
Intellectually I think Roberts has a point. The State of the Union wasn't meant to be a big political show or speech and for much of US history the President just sent a note to Congress on the state of the Union. Unless Roberts has been living in a cave since the 19th C. he should know that tradition now dictates the State of the Union as a big show and essentially an annual inaugural speech for the President to lay out a political speech. It strikes me as petty on his part to be boo hooing about the poor Judicial Branch is being ganged up on by the other Branches at the State of the Union.

Yes, of course, Obama should know that it's necessary to wait a certain amount of time in order to criticize a decision by the Supreme Court... Could you clue us in to the necessary amount of time he needs to wait before he expresses his criticism? TIA.
The Obama administration is planning on appointing at least two more SC judges before 2012; probably at least one more before he leaves office. The court could be very interesting by 2016
It's one thing to complain about an actual statement that you think is racist or indicates racism. But randomly inserting the charge into the discussion for no apparent reason doesn't make sense to me.
will those new justices vote differently than the ones they replace, assuming he get's to make any appointments before he leaves office in 2013? the great legacy of the Bush era, in addition to a free and democratic arab nation in the heart of the middle east, is a conservative majority on the SC for many years to come.
