More ABUSE from the left in the name of the 1st admendment...

    Drinking under 21 does cause harm to others....the law was moved from 18 to 21 to protect people from drunk underage drinkers.

    Smoking pot is illegal for other reasons - because people feel the need to protect people from themselves. You may not think it causes harm, but other people think it's self-harm.

    Sending dog poop doesn't cause anyone harm. She clearly was doing it to tell them what she thought of them. She didn't break any laws. But she is a crude person for doing it.

    If you want to pass a law barring sending people dog poop-i'd say go for it, but it happens infrequently enough that it's probably unnecessary. Again, why are people making such a big deal about poop?

    Underage drinking in and of itself absolutely causes no harm to others. Drinking and driving, attacking people while drunk, etc. all cause harm to other people, but are also all crimes regardless of age.
    Even if it does cause self-harm, that is not illegal. You are allowed to cut yourself, punch yourself in the face, drink, smoke, have unprotected sex, etc. Smoking pot is illegal for several reasons (mostly politics) but causing harm is not one of them.
    Sending dog poop likely doesn't cause any harm, but no one argued that it did.
    I'd say it is probably covered by existing statutes. You and the Colorado jury disagree.
    Why do we discuss anything here?

    I just don't see how sending poop is anything more then not curbing your dog. Really, to compare it to a kid who gets drunk (and could potentially become a threat to others by driving) or someone smoking pot (which is viewed by some as being dangerous) being compared to dog poop.

    I just feel this is a waste of our court system and it would be really sad to have laws enacted to prevent it.

    They are going after the women because of political reasons - because first they were mad, and then they found out she was off the opposing political party and saw an opportunity. Really...which is worse....sending dog poop in the mail system, or clogging up our court system with the crap.

    Actually, mailing this is argubly illegal under the Postal Regs

    Reg 8.4 states
    "It also includes matter not otherwise described in 8.0 through 10.0 and 11.0 that is restricted by 18 USC 1716(a) because it may, under conditions encountered in the mail, be injurious to life, health, or property (obnoxious odors, liquids, powders, and battery-powered devices)."

    Dog crap seems to fit under a substance with an obnoxious odor.

    Reg 8.5 states
    "Except as provided in this document, any article, composition, or material is nonmailable if it can kill or injure another or injure the mail or other property. Harmful matter includes, but is not limited to:

    a. All types and classes of poisons, including controlled substances.

    b. All poisonous animals except scorpions mailed for medical research purposes or for the manufacture of antivenom; all poisonous insects; all poisonous reptiles; and all types of snakes, turtles, and spiders.

    c. All disease germs or scabs.

    d. All explosives, flammable material, infernal machines, and mechanical, chemical, or other devices or compositions that may ignite or explode"

    If you are mailing fecal material, you are also mailing the disease germs contained therein. Therefore, 8.5(c) may bar mailing it.


    This should steer the argument a little. Carry on.

    I don't think they had dog poop in mind for number C nor meant poop smell as obnoxious. I think they meant a smell powerful enough to make eyes water or hurt people. LIke a chemical weapon or such. And by germs I don't think they mean bacteria....more like something such as small pox.
