    Democrats, with their 'Resist Trump!' ethos, stupidly tried to block Gorsuch and failed. Now, with Kennedy retired and RBG about to keel over, they have no political maneuvers left. For as much as everyone dislikes McConnell on both sides, he has raped the left on SCOTUS nominees.

    If Rowe or Obergfell is overturned, that would not make abortion or homosexual "marriage" illegal. It would return the matter to authority of the states, which would each craft its own law, as they considered appropriate.

    It's common sense to think so, but actually the data tells us the opposite.
    Of all factors including race, income, age, education etc - the number one single determining factor for strong support for Trump is if the subject is self-identified evangelical. It's baffling, I agree, but there's no group that loves him more.

    I mean, us liberals have always pegged them as ridiculous hypocrites, but even in our wildest dreams we never thought they'd sink so far. They didn't hold their nose and vote for him- they jumped in with both feet and they're leading the bandwagon.

    The first sentence of your post is true, and the current state of American evangelicalism is going to accelerate that.

    I’m not understanding this. If those are ruled illegal by the supreme court, what can the states do?

    Overturning Rowe or Obergfell would not make abortion or homosexual "marriage" illegal. It would just repeal the decision that ordered the current court-mandated, nationwide policy. That being eliminated, state law would apply.

    When conservatives pursue the overturning of these two SCOTUS mandated policies, this is what they are looking forward to.

    So, conservatives are looking forward to spitting on the constitution and telling religious nuts that they get to enforce their laws on gay people depending on the state, got it.

    TBH, it’s not like Kennedy was truly a swing vote in the modern era. Since 2008, has he sided once with the minority?

    The Day to Day rulings on issues aren’t going to be any different than they were before. We just might seem more extreme positions taken in the majority decision but we are still trading a 5-4 majority for a 5-4 majority, and of course Roe V Wade being overturned potentially.

    The problem is the trump loyalty pledge and cloud under the name of this new judge. We have a president under investigation whose fate could lie on a Supreme Court decision that ends up being decided by two justices who (let’s face it) will get the nomination by pledging some form of loyalty to Trump.

    Trump’s Supreme Court List
    In a bombshell announcement, Justice Anthony Kennedy revealed this afternoon that he is retiring from the United States Supreme Court. The Court’s next term begins on Monday, October 1, which means that President Trump will need to name a replacement very quickly. In a statement today, Trump said that he would choose the nominee from a list of 25 candidates previously identified by the White House. As he explained, “There are certain names that are just outstanding, names that you already know, to be honest with you. But they will come from the list of 25 people.”

    According to the White House website, this is the list of 25 candidates that President Trump will consider for replacing Justice Kennedy:

    The issue is the predictability. If conservatives feel the court will always rule 5-4 in their favor you are going to see more pet cases reaching the SCOTUS.

    Really our only hope is that one of the conservatives decides to become the swing voter as there is a lot of power in that role. Roberts would be the one I think more likely to become this. It is his court after all. I could see him trying to protect his legacy on certain cases and he has no reason to be loyal to Trump at all being an appointed judge of Bush.

    Well I'm not prepared to say what the White house and Senate will look like that far in advance, but for sure she better hope she can hold on for at least another 2 years.

    BS rhetoric like this and what you were responding to is a large reason why Trump is president and the Republicans took over the House, Senate, White House, and are now in the position to create a conservative dominated SCOTUS for a generation.....but by all means, keep it up.

    Well, duh. It was necessary with the historically uncooperative republican congress.

    You can fingerwag and chortle all you want, but the truth is that this rule change is going to come back around and benefit democrats at some point as well.

    This isn't the reason at all. The reason is democratic turnout was low because Clinton was a terrible candidate.

    Also, you never say this when people on the right call liberals evil. I've never seen you warn a conservative about "What out for that rhetoric, it's going to put a liberal in office."

    The point I've been trying to make the last few days is that if a person willingly gets down into the mud to wrestle with a pig, he doesn't make the pig look bad, he just makes himself look bad.

    You are right that picking a terrible candidate like Hillary is what doomed the Democrats, but on top of her normal baggage she chose to mix it up with Trump instead of trying to stay above it and it only served to drive even more people away from her.

    Divisive rhetoric only serves to push people further apart and right now the Democrats need all of the outside help they can get.....and they can't get it by demonizing everyone that fails to be in lock step with them.

    I personally thought that Trump's rhetoric was going to be the thing to elect Hillary but apparently he's just better at this game of being the douchebag that brings out the douchebag in others and somehow uses it against them. I'd never vote for the son of a b****, and I think eventually it'll backfire, but continuing to play into his hand isn't the way to beat him.
