Geico ordered to pay Missouri woman $5.2 million after she contracted STD in a car

    That was very clever.

    I had many many many dangerous car encounters of this nature in high school, college and in my 20's...and in my 30's. Where do I file? Will this increase my rates? Is this why teenagers insurance costs so much more?

    As to his substantive findings, the arbitrator determined that:

    (1) “there was sexual activity in [Insured’s] automobile in November/December of 2017 which occurred in Jackson County, Missouri”;

    (2) the sexual activity in Insured’s vehicle “directly caused, or directly contributed to cause, M.O. to be infected with HPV”;

    (3) Insured knew he had “been told that his throat cancer tumor was diagnosed as HPV positive”;

    (4) Insured should have disclosed his diagnosis to M.O. prior to the sexual activity that occurred, but he did not; and

    (5) Insured “was negligent and is liable for causing M.O. to contract HPV.”

    So now car insurance companies are going to need exhaustive, uncensored medical histories? The implications seem insane. If anything bad happens to you in a car, the insurance company is liable now?

    Seems like the car insurance provided should be limited to car related stuff.

    No, the person who is at fault is liable. The car insurance company is paying in lieu of that person if that person buys insurance. Even though the jury awarded $5.2M, I doubt the insured purchased coverage worth $5.2M. That was just for the headlines. It's probably a max claim of $50k or $100k or whatever he bought.

    It's just like he caused an accident. Instead of defending him or paying the lady, GEICO was like, they'll just deny the claim and leave it to the abitrator. But after the ruling, GEICO tried to take it seriously, but then court was like, too late, you had your chance to defend and passed.

    Also, I'm not sure that this is the end of the case. I don't think GEICO wants to pay anything (other than lawyer fees).
    Another thing. Car and Home insurance pays for a lot of crap that the insured does wrong. Like if you're sued of defamation or slander, you are potentially liable and your home insurance could cover that up to your policy limits.

    Glad I read the story. Glanced at the headline and figured she got a rental and contracted the STD sitting in the previous renter's mess.

    Almost as bad as this case. Thank god this judge in this video was a hell of a lot smarter then the judge above
