Justice Department centralizes control of sensitive insider-trading probes
The department’s Public Integrity Section, which has a mixed record in complex corruption prosecutions, is looking at whether senators broke the law with coronavirus-related stock trades.

The Justice Department’s highest-profile coronavirus prosecutions are being handled by an office poised for leadership changes, two people familiar with the cases told POLITICO. Investigations of lawmakers for potentially illegal insider trading based on government briefings on the pandemic are being run by the D.C. U.S. Attorney’s Office, in conjunction with the Public Integrity Section at Main Justice, as the department’s headquarters is known. The central location of the probes points to close coordination of investigations that could have immense stakes. And it may present a new test for one office that’s seen intense turmoil and a second that’s faced a series of high-profile defeats.

Multiple U.S. Attorney’s offices — including the Southern District of New York — wanted to handle insider trading investigations of lawmakers, one of the sources said, but all the probes have been centralized in D.C. It would have been logical for SDNY to have jurisdiction: Wall Street is located there, and the district has extensive experience investigating and prosecuting complex financial cases. Other offices that telegraphed interest were the residences of potential targets. Spokespersons for the Justice Department and SDNY declined to comment.

Federal prosecutors are still investigating stock sales by Sen. Richard Burr of North Carolina in advance of a coronavirus-fuelled share price plunge, but are dropping investigations of such sales by three other senators: Kelly Loeffler, Jim Inhofe and Dianne Feinstein, according to a new report Tuesday. The Wall Street Journal reported that prosecutors from the Department of Justice on Tuesday are informing lawyers for Loeffler, R-Georgia, Inhofe, R-Okla., and Feinstein, D-Calif., that they are no longer probing stock sales related to them. The FBI earlier this month seized Burr’s cell phone at his home in Washington, D.C., as part of an ongoing criminal investigation. The next day, the Republican stepped aside as chairman of the Senate Intelligence Committee.

Burr and the other three senators have denied any wrongdoing in selling off shares, or their spouses selling off shares, worth cumulatively millions of dollars in the weeks before stock prices collapse as the Covid-19 pandemic began spreading rapidly in the United States. The Department of Justice and a spokeswoman for Burr declined to comment on the Wall Street Journal’s report.Spokesmen for Loeffler, Feinstein and Inhofe did not immediately respond to requests for comment.

Burr on Feb. 13 had sold stock shares valued at between $630,000 and $1.7 million in 33 separate trades. ProPublica has reported that on the same day Burr sold his stock, his brother-in-law, Gerald Fauth, also sold tens of thousands of dollars worth of stock.Loeffler’s husband Jeffrey Sprecher is CEO of Intercontinental Exchange, the company that operates the New York Stock Exchange, among other financial marketplaces. A spokesman for Intercontinental Exchange, known as ICE, declined to comment.

CREW FILES CRIMINAL COMPLAINT AGAINST PENCE CHIEF OF STAFF

Vice President Pence’s Chief of Staff Marc Short appears to have violated criminal conflict of interest law by holding stock in companies that are directly affected by the government’s pandemic response and participating in meetings with those companies, according to a complaint sent today to the FBI by Citizens for Responsibility and Ethics in Washington (CREW). A prominent member of the Trump administration’s COVID-19 pandemic response efforts, Short plays a critical role in addressing the economic and health impact of the pandemic, determining the agenda for meetings of the coronavirus task force and communicating the administration’s coronavirus response to the public. CREW first noted Short’s possible conflicts of interest in April after discovering he had not filed periodic transaction reports disclosing sales of his stocks. In May, NPR reported Short had not divested any of his stock interests, and Short claims to manage his conflicts of interest by recusing himself from matters that may affect his holdings.

Short’s work on the pandemic, however, reportedly included attending meetings with executives of the companies in which he holds stock. The White House press office said Short was expected to attend several meetings in March and April related to the pandemic response with representatives from companies such as United Health Group, CVS, Johnson & Johnson, Pfizer, Wal-Mart and Disney, whose stock he holds, and photos show him at those meetings.
