Did they get to the part where Biden was showing them to unauthorized reporters? Did they get to the part where Biden was telling his lawyers to lie, and hide or destroy the classified documents? Did they get to the part where Biden was having employees move them to hide them? What about the part where Biden refused subpoenas to hand them over?

Stop trying to pretend like the issues are the same. Had Trump cooperated and returned all the documents, he wouldn't be facing charges right now. The cases are similar only until Biden cooperated and Trump tried to obstruct. That is where they are different. Also the part where Trump is showing classified material to guests and reporters.

I think what's funny about this whataboutism is that it's cast as a Trump v. Biden thing, but the handling of classified docs by Biden probably mirrors the negligent way most high officials have treated our national secrets. It reminds me of the stink that was made about Hilary Clinton using private email to circumvent FOIA and then it turned out that everyone in Washington did the same, and the only thing special about her was that she took it to the next level with her own server. And they probably still today dodge FOIA by using private email because we never did do anything to stop them. And they probably treat our classified docs like crap too. And the only thing that makes Trump's case special is that he did it intentionally and maliciously instead of negligently.

Has there ever been a case where the defense gets to write jury instructions and the judge gets to choose between them and ones the prosecution writes?

Don't know why this is all so surprising. All these Federalist Society far-right Catholics---SCOTUS (four of them), Aileen Cannon.

These judges can't ultimately invent law, so they're obeying their minders: obfuscate, delay. Delay delay delay.

Oh this SCOTUS absolutely has no problem inventing new law by flipping existing precedent on its head on a whim. See the ruling today where the entire book on immigration control was thrown out the window just because they wanted to play politics and appease Abbott.

They flipped the law on its head with Roe. And back years ago when Roberts had just came into Chief Justice decided out of nowhere to rule that corporations are people and have the ability to bribe politicians with unlimited amounts of money.

Cannon has learned from SCOTUS that she’s also untouchable and can rule however she wants to serve her political interest. She knows there’s no way she’ll be impeached by Congress and she knows it’ll help her in the longrun get Thomas or Alito’s spot on the bench. Mark my words, if Trump wins again I guarantee you he’ll nominate Cannon for SCOTUS and if there is a R Senate she’ll get through and serve for life. Republicans have completely destroyed the credibility of the judicial system in the US.
