Encounters is not a great metric for measuring illegal immigration. It can go up if more migrants are encouraged to come. But, it can also go up when you do a better job of stopping them. Biden can't get record encounters with an open border. Besides, since around 2008, more illegal immigration resulted from overstaying visas than by crossing the Mexican border, so the obsession with border-crossing isn't even addressing the majority of the alleged problem. As far as I'm concerned it's not an actual problem at all. According to Pew, the size of the illegal immigrant population has been tapering off since the early Obama years. If we're get invaded, why does the population present keep going down? I know a lot of voters, even Democrats, are animated by this issue and it will be a primary driver of this presidential election. But I think it is a panic that future generations will be scratching their heads about. Sure, our policies on how to manage this traffic is all wrong and results in many injustices, but it isn't an existential threat nor a crisis. It's just a dysfunctional policy that politicians probably would have fixed by now if it hadn't become a political football. Now we can't solve the problem without someone taking a political loss.
Choosing to run for President is Trump's choice. Committing numerous crimes was Trump's choice. Just because he thinks he should be able to rally and fundraise and run for President without going to trials and courts for his crimes doesn't matter. What Trump wants is irrelevant. The courts have no business coddling to a criminal's desires, just because he wants things done his way, and wants everything put on hold and delayed.
