Yeah, the girl allegedly ran out to the hotel hallway covered with blood. Somebody called 911. Very likely surveillance cam caught what happened in the hallway. If it was the girl who made the call, she told the 911 operator something that warrant a police response. If someone else made the call, there's a witness. When the police arrived, they must have taken some pictures, talked to the girl, and probably some other people there. And it was enough for them to arrest KPJ. Just because the girl did not later give the police any official statement doesn't mean they have no evidence to prosecute him.
Exactly. He might get away with being a violent and absusive piece of **** like many others who don't consider DV a true crime, but there was more to it than a he said she said situation.
Every police man and woman has a body cam ......you will eventually get to see it or not....it is used in court.
Doesn't mean the assault in the room is on camera anywhere.....if the girl flips the case will die. KPJ screwed up his career and THAT.......she is gorgeous. DD
That's only in a situation where the DV took place in a private residence and no one else was around to hear or see it. This was in a hotel lobby with a ton of witnesses and cameras. It isn't up to the girl anymore. It's up to the DA's office and judge. Even if she doesn't cooperate, the DA can just paint the scene with the witnesses and evidence they have. The guy is a special kind of stupid to do this in a Manhattan hotel. I can't think of many worse places to flip out like this. But then again he has a few screws loose so I guess it checks out.
Exactly. Her testimony is unnecessary at this point. She could even be a witness for KPJ and a half-decent prosecutor would make her look foolish. Unless she testified that she fell down a flight of stairs…inside her room…or that some mysterious third party did it…umm wait yeah there’s nothing KPJ’s legal team can do at this point to spin this.
Where did you hear it was in a hotel lobby, reporting has been it was in his room, where did you hear the assault took place in a hotel lobby? IIRC he went down and had the porter come up and unlock his room. If that is the case, and they have cameras then for sure they don't need her testimony. DD
Hallway rather. Not lobby. She came out, plenty of people saw her, medics treated her....its pretty straightforward. There's so many things. It's like Ray Rice. Who also did it I think in a hotel. Its over for him. With or without the girls cooperation.
The reports I saw say she was found bleeding in the hallway after sustaining some type of injury. If that is the case, a good lawyer and an uncooperative victim usually are good for the defense. There is also the slim chance that he really didn't do anything at all, and she lied or was misquoted/misunderstood/framing him. Jason Kidd had DV issues in his past as a player and is a coach currently. He also said at one point that she would threaten to accuse him of Domestic Abuse again to manipulate him due to their past.
Ray Rice filmed punching a chick in the face. Not the same thing. Just because she was bleeding in the hallway and needed treatment doesn't mean he assaulted her
That is the aftermath, not the actual event.......unless some witness saw it, like was there in the room etc... if the girl recants they have nothing. I guess we will find out some tomorrow as they go before the judge, but most first time offenders (and he is in NY) only get probation at worse. And that is if she testifies....if she doesn't the Rockets will have a problem because Silver's hands will be tied to a small suspension at most and the Rox will be on the hook for all 16m this year. DD
Only you and those who still have hope for KPJ's innocence would make it so complicated. It is very simple. 1. The girl ran out of her room bloody. 2. Someone called 911. 3. The police arrived. They arrested KPJ. 4. The case was NOT dismissed, which means that it's not some sort of mistaken arrest. KPJ was released on bail. The guy would not have to go to court if it could be easily spun into some sort of mistaken accusation.
Yeah, I think it would have been another statement by the league or the media if it were an easy case. A month of nothing would imply that this has been handled as classified and with care.
Easy, I am not defending him, just talking the matters of the case. And the reality is that a good percentage of DV cases get dropped because the girls back out. There is nothing wrong with talking about specifics.....no one is pining for him to wear a Rox uniform, just talking specifics out of interest in law cases etc. That is the worry, tbh, that she knows that if she wants a big settlement from KPJ on the side - she may need to recant her story - that is generally what happens in cases against people with a lot of money etc. Here is a link to a study about DV in NY in particular. https://jbassettlaw.com/why-would-a-domestic-violence-case-be-dismissed-in-new-york/ Here are some interesting clips....from the study. The Accuser is Not Cooperating With the Prosecution In some cases, the accuser stops cooperating with the prosecutor. If the accuser declines to submit to a witness interview or doesn’t show up for court, the prosecution may be forced to dismiss the case. The Accuser Recants Their Story Although an accuser can’t drop the charges, they can recant their statement. This means that the victim has admitted that they were lying. Although the state may still prosecute, if there is no other supporting evidence of a crime, a prosecutor may decide to dismiss. What is the Usual Ending for a Domestic Violence Case? Domestic violence cases are not guaranteed to end in a certain way. It all depends on the circumstances and any aggravating circumstances. It is important to remember that domestic violence cases rarely end in a trial. DD
Maybe but in this case the girl did not back out immediately and at least there was no indication that the DA wanted to drop this. By logic, dropping this would at least give us more information because the case would not need this. NY can process this without the girl ever giving testimony......
Lol nope, she making her money is not the same as to beg others for money. How many times again, a DV case in NY does not need her to testify .....it would be good for the case if she did... The DA will process that, it is a high profile case !!!!!
