I got into a wreck, do I need a lawyer?

    Yesterday night I got into a pretty bad car wreck. I was on 610 heading north waiting to get onto 59 south. Traffic was backed up and this lady in a van plowed into me at about 20-30 mph. My poor Maxima’s trunk is crumpled. Luckily the lady had insurance. I went to Methodist’s ER and after a trillion x-rays everything came up negative.

    So today I try to get in touch with her insurance people (A- Abana). I called and left a message at 11am and did not hear back from them the entire day.

    At what point do I need to get a lawyer? What benefit do I have and how much do they charge for stuff like this. I basically want my medicals bills paid and get my car repaired if possible or get it totaled out.

    Anyway, what do you guys suggest in regards to getting legal representation. Would you all do it?

    Sadly the car had a full tank of gas :(
    I was going to wash and wax it, I am glad I decided against it. :p

    I would contact my insurance and let them handle all that crap. They take care of your crap up front and go after her insurance to pay for all the repairs. No reason you should be chasing them around.

    Exactly, your insurance should be dealing with them. That may even be why you haven't heard back directly.

    Regardless, some smaller/lesser-known insurance companies are hard to get in touch with. During the dealings with my last accident, it took almost a week to actually speak to someone (though they did call back after 2+ days)

    Yeah. Got your eye on the new Infiniti? Now you can afford it. I know some doctors who will check you out and find a tumor for 20% of the take. :D

    Yeah but I have real back pain and real neck pain. I hate having to take drugs but right nwo it tis the only thing making my neck feel normal.

    I was involve in an bad REAR end accident not to long ago ... CALL your insurance and tell them what happen they'll make a CLAIM on it.... then go find a LAWYER/Accident they take your case free of charge and find you a CHIROPACTOR and you'll be visiting them for about 2months ... and after is all said and done you could be collecting $10-15k like I did :)

    Okay maybe not. Don't personal injury lawyers take a substantial cut, like 30% of winnings?

    Wait and see how things work with the insurance company first, but document EVERYTHING - doctor's visits, bills, your various pains, etc. If they try to settle with you early, be careful.

    When you get your next car - adjust the headrest. This is something most people don't do, but can save you from a lot of unnecessary pain.

    1) He would be subject to a deductible, where if he dealt directly with the other party's carrier, he wouldn't.

    2) His insurance will normally only attempt to recover what they paid out, not his deductible.

    3) His insurance will then have a record of him filing a claim, which is subject to underwriting at time of a policy renewal. Any claims on your own policy will affect your rates.

    Overall, this is bad advice. Deal directly with the other party's carrier, sans lawyer, and try to work it out with them.

    Your insurance company should be taking care of it all. If you lose time at work and the medical bills start pilling up, then get an attorney.

    Sorry about the pain, but I'm glad to see that you are alive.

    I am meeting with a lawyer at lunch

    After talking with the general counsel here at my office she said he can help to get the car totaled and he will also make sure to get your medical bills paid and if you have pain in the future he will get extra cash. She said once you settle with the insurance company you are done. So if in a year I need surgery on my back, I am SOL.

    I feel better about it because the nice lady who hit me is only going to have to pay her deductible. I was thinking a lawyer was going to go after her.

    Sorry to hear about it...Don't forget about the diminish in value on you car...A repaired car is worth less...Go to physical therapy if you need to, even just to get a case...I heard this guy was pretty good (j/k)

    Get a lawyer. My wife was in an accident and after 3 months of chiropractic visits the other person's insurance company said they weren't going to pay the bills. My wife got a lawyer, and in the end they paid the bills AND we got a check for $3,500 on top of it, in addition to the $1,000 we got for diminished value since it was a new car. That was after they took out all legal fees. It took over a year, but it was worth it.

    What was the Lawyers take? 20, 30 , 40 , even 50 percent?
