unless he can't be guilty because he doesn't have the capacity to form the necessary mental intent.

Acquiring ammo over 4 months, rigging 30 bombs in your house, etc, shows plenty of mental intent. He might be crazy, but his ass needs to fry.

Judging by his appearance yesterday it wouldn't surprise me if they found him mentally incapable of standing trial. If I remember that was the same finding for Jared Loughner even though he had showed planning and premeditation in the shooting of Gabby Giffords.

Has anyone heard any more recent estimates of the cost of the stuff he bought? I heard yesterday that it was more like $6000 worth of supplies/weapons.

If it is shown that the theatre was negligent about securing the exit door that Holmes came through there might be a case. In related news I heard a report that Warner Brothers is planning on donating money to the victims and is working with Colorado on how to set up a fund. This might be out of good will but it might also be possibly heading off potential lawsuits.

that will be the prosecution's argument...but that certainly isn't a slam dunk. people can fail to know the difference between right/wrong and live in an absolute fantasyworld without regard to reality, and still scheme.

I hate frivolous lawsuits. The way Holmes entered the theater by propping an exit door open is replicable in ANY public building.

My opinion is the only way the theater can be liable in any way is if it shows gross negligence that is outside the normal standard of similar establishments. Basically meaning this theater had to have HELPED Holmes in some way by opening the door for him.

This guy filing the lawsuit is just trying to make a quick buck out of a terrible situation. The theater is not at fault, the doctors are not at fault, and the movie is not at fault.

What does it matter and what are the consequences? If someone is a paranoid schizophrenic completely enveloped in elaborate delusions, how does that change the legal process and their ultimate fate?

Reportedly they already donated a "substantial amount" to an existing fund the city has to help citizens. They said they won't be releasing the actual amount.

And has no one mentioned the guy arrested in Maine, who had all those guns in his car and home, along with clippings of the massacre?

I mentioned earlier it was reported the total amount spent could be as "low" as $6000. That wouldn't be hard to come up with, if he's combining credit cards, loans, and any savings he had.
