I’ll skip the rhetoric and focus on the facts. The law gives ICE discretion in enforcement. For example, someone who crosses illegally can still lawfully claim asylum, and ICE can choose not to deport them. Family separation is not an automatic requirement of the law. It reflects a moral and policy choice in how the law is applied. Under natural law, the protection of family and children is a higher standard than human-made laws.

On January 14, two ICE officers were involved in a confrontation with two Venezuelan immigrants in Minneapolis that ended with one of the agents shooting one of the men in the leg. ICE Chief Admits Agents Seem to Have Lied About Why They Shot Someone Today, that case has been dismissed and those officers are under investigation for lying under oath—according to acting ICE Director Todd Lyons. This shooting happened one week after Renee Good was killed, and just over a week before Alex Pretti was killed. Trump 2.0, via Kristi Noem, lied to American public about both of those events, as well.
Tom Homan: "ICE is a legitimate federal law enforcement agency. We're not out scouring the streets to disappear people or deny people their civil rights or due process." OK, sure. When was the last time a legitimate law enforcement agency felt compelled to publicly assert their legitimacy? I can't think of any at the local, state or federal level. Maybe the FBI in the very early months under J. Edgar? ICE and CBP are in trouble and it was entirely predictable. We are yet so far gone that public opinion does not matter and when it dramatically turns against you, there are two choices: you either change policies and actions or you offer up sacrificial lambs. The administration seems to have made the latter choice, which is, of course, the more dangerous and unstable one. After a year of telling these yahoos that they are supported and that the administration stands behind them, the guys (and a few girls) on the ground will rightly see the labelling of their comrades as liars as a betrayal. This makes some less likely to go wilding on American streets as is desired by the White House and DHS, and more likely to sabotage operations and offer up damaging internal info. We are not talking the best and brightest here. Their reactions will be visceral. Of course, some will think they will never be sacrificed and will continue the terror, but eventually accountability will come for both the rank and file and the leadership.
We already know that ICE lies in court. We also know that ICE ignores judges' orders. We also know that ICE illegally jails people. We don't fully know the scale of the lying, the ignoring of judges' orders, and the illegal jailing of people... But here is some hint of the scale... Courts have ruled 4,400 times that ICE jailed people illegally. It hasn’t stopped. In at least 4,421 cases, more than 400 federal judges ruled since the beginning of October that U.S. Immigration and Customs Enforcement is holding people illegally as it carries out its mass-deportation campaign, Reuters found.

Just stopping in here to give an update from MN. It does appear the ICE withdrawal is underway but most here are still wary. There is more and more evidence that Homan and the administration have been misleading people. Recent report from Reuters has said that ICE has wrongfully detained 4,400 people and also federal prosecutors had to ask for charges to be dismissed against Julio Sosa Celis who was shot in the leg after ICE agents claimed that he and another man had attacked them with snow shovels and brooms on Jan. 14 in north Minneapolis. Those of us in Minneapolis knew ICE’s claims didn’t add up. A friend of mine lives in that neighborhood and was hit with a rubber bullet following the shooting of Sosa Celis. We also have known that ICE was detaining people unjustly and they are losing several cases in court. Also further eroding trust between the people of Minnesota and the federal government the FBI is not cooperating with State agencies on the shooting of Alex Pretti. They are continuing to withhold evidence. Even as Tom Homan claims there is a lot of cooperation between Federal and local authorities that cooperation at best is one sided. In good news the weather warmed up significantly this past weekend with temps in the 50’s so we have been seeing a literal and figurative ICE out in MN. Pressure though is still continuing with protests continuing to happen almost everyday. Few people here actually trust what the administration is saying and given the many proven false and misleading statements from Homan and others along with the lack of cooperation on the Renee Good and Alex Pretti investigations.
