    not only that, but they ignored Exodus 21 which treats a fetus as property and not a person.

    So, in 1872, Alabama passed a law that said you can sue people who negligantly cause the death of your minor child. In 2011, the Alabama Supreme Court decided a case and stated that "child" includes unborn child or viable fetus. It was reaffirmed in 2012 by the same court. Nobody challenged those rulings in neither 2011 nor 2012. Alabma accepted as legal precedent in their state that lawsuits punishing those who kill children include unborn children. I think there is a somewhat similar law passed during Bush 2 that did the same about murdering pregnant woment or something.

    Anyhow, this is a liability determination regarding an 1872 law. All the legislature would have to do is have carveouts for IVF or consent agreements regarding embryo care; otherwise, IVF facilities cannot exist in Alabama practically due to the high liability burden.

    So this ruling is about liability, based on Alabama statute and legal precedent. I will be curiously following this issue.

    Because he's a bible thumper. I'm assuming most Alabaman officials are bible thumpers or fake bibile thumpers or whatever. It's not "based" on the bible as much as it's based on Alabama precedent.

    We really only have one trick for policing corruption in the top offices, which is impeachment. But I think we've pretty well established by now that impeachment has been neutered by partisanship, so we're all just splayed open for whatever corruption a president, a justice, or a senator cares to engage in. Especially the justices because they don't even face re-election.

    nikki haley agrees with the alabama court decision. Women now in alabama won't be able to have children via IVF.

    It's a huge failure of the founding fathers. Impeachment is ineffective when you need it the most. It should have been grounded more in an independent oversight board instead of a political process. There could also have been clearly defined automatic triggers (as a low bar).

    The founders themselves were aware of this problem which is why Washington specifically warned of the dangers of parties in his farewell address. The problem was that they also feared putting it in the hand of the Judiciary would be too much power for that branch.

    Standards for impeachment could be conducive into House and senate rules. The Constitution specifically leaves Congress to make its own rules and we’ve seen them do they on a variety of other constitutional issues.

    This is not surprising. I'm guessing many people in Alabama government are like this and many people in Alabama society are like this. I've been enjoying reading the Hawaii Supreme Court saying, sure, we'll follow the law by SCOTUS, but at the same time, we are HAWAII and we are the final interpreter of Hawaiin law.

    Alabama law may be based on some weird bible interpretation cult, but Hawaii law is based on the Aloha Spirit. Boom.

    In Hawaiʻi, the Aloha Spirit inspires constitutional interpretation. See Sunoco, 153 Hawaiʻi at 363, 537 P.3d at 1210 (Eddins, J., concurring). When this court exercises “power on half of the people and in fulfillment of [our] responsibilities, obligations, and service to the people” we “may contemplate and reside with the life force and give consideration to the ‘Aloha Spirit.’” HRS § 5-7.5(b) (2009). The spirit of Aloha clashes with a federally-mandated lifestyle that lets citizens walk around with deadly weapons during day-to-day activities. The history of the Hawaiian Islands does not include a society where armed people move about the community to possibly combat the deadly aims of others.

    Say what you will about hardcore pro-lifers, but this is the logical endpoint of their stated beliefs. The egg is really on the faces of every politician and squishy anti-abortion voter who thought the nutsos were only talking about abortion.
