Nixon was pardoned without a conviction so that can be done.

The protesters who fought the police and broke into the Capitol are clearly criminals. Many others who marched in after the breach were just going with the crowd. They are trespassers, but terrorists?

Imagine Congress was in session to vote on authorizing a war, and the mob outside were anti-war protestors. If they broke in to disrupt the session, in the same fashion that these people did, are they terrorists as well?

You may say that protesting a war is different than protesting certification of a democratic election. OK, but from their (misinformed) perspective the election was not democratic but rather stolen.
