Cuban's contract writing creates FA/trade leverage for the Mavs?

    A couple articles off of DallasBasketball.com by former (and I guess current) D/FW radio personality, Mike Fisher. He always had pretty good access to Mark Cuban, and he goes onto detail how these partially guaranteed contracts (Stackhouse's this year, Dampier's next year, and Terry's in 2011) can be used to trade for assets (due to their matching numbers) but then bought out by the acquiring team thus saving them $$ under the salary cap and maybe even more importantly, saving them on their luxury tax bill.

    We've previously alerted you to the fact that in the summer of 2010, Dampier's deal will be "Stack-like." Many fans already understand the concept, but for those who don't, here's how it works: The Mavs can currently trade Jerry Stackhouse and his $7.25M salary to another team and under the trade rules take back from them up to $9.16M in salary. When they get him, the other team can simply waive Stack and per the terms of his unusual contract, only be required to pay him $2M rather than the contractual amount of $7.25M. That would save them up to $7+M in payroll from the $9+M they sent to Dallas and perhaps just as much in luxury tax obligations. We've labeled this type of deal an "instant expiring" to highlight its desirability to a team in great need of instantly erasing payroll for budget or luxury tax reasons.


    Dampier's contract next summer will be similar, and could be even more marketable than Stack's, because on Damp's there is no buyout required to waive him, and his contract will be about twice as big as Stack's is. Double the contract can equal double the savings for the other team.

    Fisher's kind of out there sometimes, but he comes up with some good gets/finds too.

    The trick is, the player + agent have to be okay with limiting their guaranteed money. No one's eager to sign a 5 yr deal that's really only good for 4.

    Agent might be more inclined to sign it - makes for a big splash in the headlines. Some do reject it, one of the links above says that they tried to do something similar with Kidd's three-year deal.

    Bottom line is that they have Stack's partially guaranteed deal and Damp's to use over the next 12+ months.

    Hope the other owners aren't very inclined to help make the Mavs better.

    I wouldn't be surprised if this kind of thing catches on. It really is beneficial to be able to trade "dollar for 20-cents-on-the-dollar" contracts without bumping up against salary cap rules.

    And one other salary cap wrinkle that I don't think gets enough use is the "no-raise" or even "declining salary" contracts. The default way to sign contracts in the NBA is to offer full raises every year. But once you get deeper into a career, the player is invariably going to start producing less and less each year, yet they constantly get paid more and more. And if you have a bunch of contracts that are flat rate, or declining, then your salary commitment doesn't constantly grow every year making your cap situation worse and worse.

    Now for max level players, there's really isn't an option because they're going to feel entitled to the money and wouldn't appreciate non-market offers. But for non-max players, if the money is going to be the same, then why not. It's the same amount of money, just structured differently.

    These type of deals aren't unheard of but they are rare. David West has a contract that has a declining salary each year. And Monta Ellis and Biedrins have flat contracts that don't raise or decline.

    Morey would be wise to fill up our team with similar deals. It makes it a lot easier to manage the cap when salaries don't automatically go up 10% every year.

    But if the options are a 4 year deal for 40 million or a 5 years deal with 42 million in guaranteed money and 50 million if your option gets picked up, what would you do. All the GM's need to do is offer that one extra year that they otherwise might not have gotten.

    Despite all his shortcomings, I think cuban is one of the true innovators in the NBA. I think he is really the one who started the trading crap for contract deals. I remember he traded a lot contract for howard and then traded howard for something. Eventually it ended with them netting the no 5 (Harris) pick and stackhouse.
