Once again, there were massive red flags before the day of the shooting. Neighbors were scared of him, coworkers knew something was off with him. That day, he got fired from his job, his employer calls 911 but the guy is gone by the time the cops get there, the guy calls 911 and the FBI tipline after leaving, saying all kinds of crazy stuff, then 15 minutes later a state trooper pulls him over for a turn signal, not knowing about any of the calls to authorities, and the shooting starts. eta: see below And yes, he would not have been prevented from buying a gun by either the current State or Federal firearms regulations.

FYI, here's the background check criteria, from the AP: Online court records show Ator was arrested in 2001 for a misdemeanor offense that would not have prevented him from legally purchasing firearms in Texas. Federal law defines nine categories that would legally prevent a person from owning a gun, which include being convicted of a felony, a misdemeanor domestic violence charge, being adjudicated as a "mental defect" or committed to a mental institution, the subject of a restraining order or having an active warrant. Authorities have said Ator had no active warrants at the time of the shooting.
The point is some states will still hold the seller liable even in a private sale if the individual was not allowed to posses a firearm.
You know the best solution is universal background checks on all fire arms purchases. Why the NRA has so much pull to prevent that from is beyond me. How can such a small percent of the population over ride the wishes of the majority of the people.
