Chiefs' Tyreek Hill under investigation for alleged battery

    Chiefs receiver Tyreek Hill under investigation for alleged battery

    The Kansas City Chiefs have confirmed to The Star that they are aware of a law enforcement investigation involving wide receiver Tyreek Hill.

    The Star has obtained a police report from the Overland Park Police Department about a battery incident that lists a juvenile as the victim. Hill’s fiancee, Crystal Espinal, is listed under “others involved.”

    The report is dated Thursday but it’s unclear when the alleged incident took place.

    “The club is aware of the investigation involving Tyreek Hill,” the Chiefs said in a statement to The Star. “We’re in the process of gathering information and have been in contact with the league and local authorities. We’ll have no further comment at this time.”

    A source familiar with the situation said Hill’s fiancee has been in contact with Overland Park police. The source said that the incident was against the couple’s 3-year-old son, resulting in a broken arm.

    As of Friday afternoon, Hill had not been charged with a crime.

    Crystal Espinal, 24, told The Star at the January Pro Bowl in Orlando that she is pregnant with twins.

    Hill has a history of domestic violence. He reportedly punched and choked Espinal, who was then eight weeks pregnant with their son, on Dec. 11, 2014. He was arrested and dismissed from the Oklahoma State football team. Hill pleaded guilty to domestic assault and battery by strangulation in August 2015. He received three years probation. The Chiefs selected Hill in the fifth round of the 2016 NFL Draft.

    The conviction was dismissed in August 2018 and ordered to be expunged after he completed his probation requirements.

    Overland Park police were called at 4:20 p.m. Thursday to a home in the 16400 block of Switzer Road.

    Officers were previously called to that same address on March 5 to investigate a report of child abuse or neglect. Hill’s name is directly listed on that report. According to Overland Park police, the original report was closed three days later when prosecution was declined.

    Hill’s name is not listed on the most recent battery report, but his address is the listed location.

    Sources tell KCTV5 that the Overland Park Police Department has turned over their investigation to the Johnson County District Attorney's Office for review.

    The woman at the center of that investigation is now engaged to Hill. Her name is listed on both investigative reports obtained by KCTV5 involving Overland Park police. Hill and his fiance have a 3-year-old son who is connected to the Overland Park address where police were called.

    As an Assistant District Attorney, I just want to throw in my two cents. Take it or leave it. These cases are highly fact-intensive, so it's hard to provide a true analysis without knowing the alleged facts. That said, a brief overview of the law may be helpful to those interested in how this case will play out.

    Injury to Child cases (in Texas) are typically going to be charged as 3rd degree felonies. Injury to Child cases do become 1st degree felonies if the child suffers "serious bodily injury". That basically means permanent disfigurement, or the injury itself creates a substantial risk of death (e.g., child is severely malnourished). It's unlikely that Hill's case is elevated to "SBI" even if the injury is in fact a broken arm. Most Injury to Child cases are 3rd degree felonies, and therefore only require the State to prove "bodily injury". "BI" is defined in the Texas Penal Code as "physical pain". If the District Attorneys Office thinks a case can be made, they'll accept that charge and take it to the Grand Jury for indictment.

    Interesting side note: Injury to Child - Bodily Injury requires the State to prove the same elements as those found in a Class A misdemeanor assault charge, so the two are pretty analogous. The only difference is the class of the victim (child vs. adult), and that classification is why the legislature has elevated the act to a felony. The elements outside of that distinction are the exact same in Texas.

    Now, I don't know Johnson County's local laws, but the largest hurdle in ITC cases in Texas is often Texas Penal Code 9.61. This statute allows parents (and those acting as a parent) to use physical, non-deadly force that is "reasonably necessary to promote a child's welfare". That's a broad standard that gives great leeway to parents in disciplining the child. The practical effect is that in many Injury to Child cases, the State will often have to prove that the act was both unreasonable and not tied to the child's welfare. I would assume Johnson County has a similar statute. Ultimately, I wouldn't be surprised if Hill doesn't end up getting indicted. Injury to Child - bodily injury cases can be very difficult to prove beyond a reasonable doubt (especially when it's a parent-child relationship). A lot of people will see Hill not getting charged and internalize it as another high-famed athlete skirting the law, but the reality is that these cases can be very difficult to prove beyond a reasonable doubt, and that's ultimately the standard that DAOs use when determining whether to file a charge. Even when the injury is as bad as what's being reported--a broken arm, the law looks to whether the act taken was reasonable, not just the resulting injury. He will probably still face a reprimand from the league even if a criminal case cannot be filed, but just something to consider.

    If pushing a girl gets you 8 games , breaking a kids arm especially after his other transgression should get you a year or more. I don't think hunt even got charged.

    JOHNSON COUNTY, KS -- We have new information in the Tyreek Hill investigation concerning allegations of child abuse. KCTV5 News has confirmed with multiple sources that Hill temporarily lost custody of his child, pending further court action.

    DA declines to file charges against Tyreek Hill and Crystal Espinal

    The district attorney went on to say he believes a crime took place, but he could not prove it with the evidence that has been presented.

    The criminal portion of the case has concluded and is final. The child protective portion of the case continues

    The DA says he hasn't talked to the K.C. Chiefs, "nor does it have any bearing on it."

    Howe also added the boy is currently safe. He declined to confirm whether the child was taken from the home at one point

    He also declines to say whether the boy is currently with Hill and his fiance

    Howe on why he is being vague on the details of the case: "There is an ongoing child protection investigation and when those cases go forward, we are very limited as far as what we can divulge."

    Howe reiterates that it is "fair" to say that he believes someone hurt the child, but he can't prove who did it

    Howe says the record of the case will probably be sealed b/c it is a child protection investigation

    Howe also said the NFL has asked for records and information on the case but he has declined to give them information

    Howe, when asked if he's frustrated he can't file charges:

    "Absolutely. Because a child has been hurt."

    So how long down the line will this thread be brought back from the deal because Hill is in prison, his kid is dead or everyone involved is in prison or hurt?

    He threw away a Hall of Fame career, celebrity, wealth and everything......... just because he is a worthless POS.

    Maybe Andy Reid should have someone else decide on the ethics part of the equation after Hunt and Hill in less than a year, and the issues Reid's sons have had.... Their young QB better be careful or someone on his team may rob and shank him in the Arrowhead parking lot.

    "You need to be terrified of me, too, B**ch" - Wow. Impossible to explain that away or walk that one back.

    Joe Mixon has a job in the NFL though and we all saw him cold **** that OU girl. So who knows.

    I think beating up a kid is way worse. I think chiefs gm needs to be fired for not cutting this dude asap.

    Obviously they are both horrible acts that should/could rightfully exclude employment by the NFL.

    "way worse" - Have you seen that Mixon footage? He could have killed that woman with that punch and that's not an exaggeration. One of the most brutal (real) things I've ever seen.
